Caddo District Judge Michael Pitman has ruled in favor of Shreveport businesses overcharged for services from the City of Shreveport Water & Sewerage.

The lawsuit on which Pitman ruled was filed on August 6, 2018, by attorneys Jerald “Jerry” Harper and Anne Wilkes on behalf of The Haven subdivision and the Briarwood Apartments.

As the attorneys previously explained …

… “The lawsuit alleges that the City of Shreveport knowingly and intentionally overcharged its commercial and industrial water and sewer customers during the time period from July 1, 2015 to approximately September 2018. The City has denied liability for these overcharges but has begun sending refunds to some of these customers with large accounts.”

In February, Judge Pitman ruled that the lawsuit “… properly qualifies as a class action and may proceed to determine the liability of the City under those allegations.”

This morning, Judge Pitman granted a Class summary judgment, imposing liability against the City of Shreveport.

Harper noted to me by email that the amount of damages will be calculated later in a separate hearing, and that a very similar motion is set for next month in a like residential class action which is also before Judge Pitman.

Mayor Adrian Perkins is “vigorously opposing” the suits and any required repayment to customers of fees illegally charged.
